Terms & Conditions

These terms govern your use of the Wayana peer-to-peer car rental platform. By using the platform or completing any booking you accept them in full.

This text is provided for operational and protective purposes and is not legal advice. It must be reviewed and approved by a qualified lawyer before official launch.

1. Nature of the platform

Wayana is a technology intermediary connecting car owners (lessors) with renters. It is not a party to the rental contract, does not own or rent out the cars. The rental relationship is directly between owner and renter; Wayana's role is limited to verification, booking confirmation, payment, evidence keeping and dispute resolution under these terms.

2. Eligibility and minimum age

The renter must be at least 21 years old and hold a valid Egyptian or international driving licence issued at least one year earlier. The owner must be at least 21 and be the lawful owner of the car or duly authorised to rent it. The company may request further documents or refuse any account at its discretion.

3. Verification and security review

Every account undergoes identity verification (KYC) before renting or listing. Required documents differ by segment (Egyptian resident, Egyptian abroad, foreigner). The company reviews documents for security and decides to accept, reject or request completion within a target of 48 business hours. Approval is discretionary, not automatic.

4. Owner obligations

The owner warrants that the car is lawfully owned, roadworthy and safe, with a valid licence and insurance, and that its listed data, photos (up to 10), mileage and condition are accurate and up to date. The owner must hand the car over on time and in the agreed condition and must not list a car subject to legal impediments.

5. Renter obligations

The renter must use the car lawfully and personally, must not sublet it or take it outside the agreed use or outside Egypt without written consent, must not drive under any impairment, and must return it on time in the same condition and fuel level. The renter is solely responsible for any traffic violation, fine or damage during the rental period.

6. Booking, confirmation and payment

Every booking passes through owner approval (or instant booking if enabled) then admin confirmation before payment is opened to the renter. A booking is confirmed only after payment is completed on-platform. Short-term rentals run 3 days to 3 months; long-term rentals run 3 months or more.

7. Fees and security deposit

A service fee, shown clearly before payment, is charged to the renter, and a platform commission is deducted from the owner's settlement statement. A refundable security deposit is held, sized by car category and rental duration, used to cover damage, fines, fuel shortage or late return, with the remainder refunded after inspection.

8. Cancellation and refund policy

Free cancellation: within the allowed window the renter is refunded the equivalent of 20% of the platform service fee within 15 business days. Non-refundable or late cancellation: 15% of the rental value is converted into on-platform wallet credit for future use. Each case is shown at cancellation time.

9. Handover, return and inspection

Both parties document the car's condition with photos, odometer reading and fuel level at handover and return through the platform. These records are the approved evidence in any dispute, and both parties must cooperate in documenting them accurately.

10. Settlement and entitlement timing

Owner earnings are transferred after the rental ends and the inspection period passes with no confirmed damage or violations, within a business period stated in the settlement statement. The company may withhold earnings wholly or partly pending any open dispute.

11. Damage, violations and fines

The renter bears full responsibility for any damage to the car or any traffic violation, fine or charge arising during the rental period; these are deducted from the security deposit, and any excess is payable by the renter. These terms do not relieve the renter of liability for negligence or misuse.

12. No off-platform contact or payment

Exchanging phone numbers or contact details, or completing payment outside the platform before confirmation or to bypass its fees, is strictly prohibited. The platform automatically masks numbers and contact details in chat, and any circumvention exposes the account to suspension and forfeiture of related earnings.

13. Disputes and resolution

When a dispute arises, either party opens a report on the platform, and the company decides based on documented evidence. Its decision on allocating liability, deposit and earnings is final at the platform level, without prejudice to the parties' right to seek the courts.

14. Suspension and termination

The company may suspend or terminate any account for breach of these terms, suspected fraud, repeated cancellation or abuse, taking whatever is necessary to protect other parties and outstanding entitlements.

15. Limitation of liability and force majeure

As a technology intermediary, Wayana is not liable for indirect or consequential loss, nor for force-majeure circumstances beyond its control. Responsibility for the car's quality and fitness remains with the owner, and for driving and use with the renter.

16. Governing law and jurisdiction

These terms are governed by and construed under the laws of the Arab Republic of Egypt, and the Egyptian courts have jurisdiction over any dispute not resolved amicably or through the platform's mechanism.

17. Changes to the terms

The company may update these terms from time to time, effective upon posting on the platform. Continued use after an update constitutes acceptance of the revised version.
